California Residents Prohibited from Joining Amazon Affiliate Program

California passed AB 28 which implements an internet sales tax on all purchases made by California residents. I can, and I think California residents can, live with the new tax on internet purchases. What I don't understand about the new law is why they felt taxing purchases made through an affiliate in California was necessary even when the purchase was made by a non-California resident.

Overstock.com and Amazon.com decided that it made good business sense to eliminate affiliate members who live in California and other states who have adopted similar laws. Amazon is fighting these states in the courts but for us affiliates we just have to wait an see. Companies in these states rely on income generated from these affiliate programs. I think these states have just put out of business some of these companies. Thanks California for helping your residents try and make ends meet in this horrible financial crisis that Wall Street and government employee greed has created. Affiliates are small business owners and middle class families who try and make just a little more to take that vacation or even pay for groceries. Thanks for thinking about who this hurts in the long run... the same people who are trying to pay what they owe, not lose their homes and pay for their own food. They also may help some other families by providing a few more jobs.

Colorado also signed such legislation and ejected existing affiliates and banned Coloradans from joining. I have written 2 hubs on this.

Now, there arises some questions:

Is Amazon liable to pay fired affiliates whatever they had earned?

Are states passing such legislation liable for lost income.

I don't have enough money or confidence in results to hire a lawyer, but did put in request for class-action lawsuit on sueEasy.com today.

the weakness of bureaucracy is bureaucracy so surely Coloradans will simply use the address of a relative or friend in another state since this whole enactment is nonsense..
